Traffic ticket defense?

My husband got a traffic ticket coming back from KY last week (for not changing lanes when passing a stopped state trooper-traffic was heavy enough that he didn't feel he could do so, and he did slow down) and it's going to raise our insurance rates through the roof. Has anyone here managed to successfully fight a ticket, or does anyone know a lawyer in the northern part of Middle TN (Robinson County) who's good at it?

Wow, that sucks. The same thing happened to me, only I didn't get a ticket. I was in Georgia, and couldn't see the trooper because I came over a hill, and there he was. I couldn't move over, and I slowed down significantly, but not to 20 under or whatever it has to be- that would have required drastic braking and probably caused the person behind me to rear-end me.

I think you could fight it- he's probably not going to even show up.

That stinks, I'm careful when traveling in the South, they don't play. I suggest goggling an attorney, preferably an EX Military Attorney, they tend to do a better job and a lot cheaper (usually) and (I speak from experience)

We wont even talk about when I went to jail for 15 days (reduced to 5) in Chester Virginia for speeding...TRUE !!!!

It's a very good law- and it seems like most people are aware of it now, but sometimes you just can't move over, if traffic is too heavy and you can't see far ahead.

Ha, I see your speeding jail time and raise you littering jail time. That's right, an empty 1 pint carton of milk, out the passenger window in the middle of the night and BAM! State trooper and night in jail?!?!? And I don't even live in the south.

To original poster... Traffic tickets are really easy to fight. Expensive, but easy. Just about any traffic attorney will get them reduced to nothing or misdemeanors. That's their job. It will usually cost waaaaay more than paying the ticket, but saves a lot in the long run with insurance and license points (if a moving violation). As Nanci said, if it's a court appearance you could bank on the issuing officer not showing up. They get busy or forget a lot. I've dodged a couple tickets noticing that there was no officer in the court room so I contested the charges. Love that legal system.

Shouldn't have been throwing trash out the window! I'd just go to court and see if the cop even shows up....tell the judge you did slow down but couldn't move over...

I call the police on people that I see throw stuff out their windows. I've lost count.

I don't call the cops but it certainly pisses me off, I get very angry when I go in the mountains at the end of my property and find trash that people dumped in the middle of the night, I've found old furniture, mattress's and all kind of crap, I hate that.
