Northern VA Snake

I haven't posted in a while but my husband ran across this guy as we were cleaning up the front flowerbeds. Not sure exactly what it is but our best guess is a copperhead. He was nice until we tried to catch him to move him away from the house. Pic isn't the best but we didn't want to get too close.

Ok...it's also been ID's as an eastern garter. Either way he was nifty (but if he was just a garter I'm bummed that I didn't play with him).

Dekay's snake, Carnita is right, we just call them by another name here. Non-venomous and do not and will not bite, but are completely fossorial and make crappy pets.

Good to know it wasn't a copperhead. Kinda stinks though - if I was sure he was non-venomous there would've been pictures of me holding him. Either way he's off in the woods with hopefully an abundance of food.
