Hmmmm not sure myself...is there a pattern there that we can't see from these photos? Where in VA are you located?

Looks like a DeKay's brown snake or a garter...but I'm leaning towards a DeKay's...

Storeria dekayi dekayi

Based on the pictures provided it looks like the species we have in the Ohio/Michigan area as well, Storeria dekayi dekayi or Northern Brown Snake also known as the "dekay's" snake. Awesome little creatures they're quite abundant here as well!.. Here's a link with a few pictures for comparison.. http://www.snakesandfrogs.com/scra/s...ages/dekay.jpg

Thank you. I also posted in the natural history/field observation because I am apparently an idiot and couldn't find the original topic that I posted this morning. Anyhoo, there are more, hopefully better pictures in that particular posting. I live in Fredericksburg, Va. Thanks for all of your help so far. Last night it looked grey, but his morning in normal lighting he is definitely brown with dark spots and the black bands on either side of the neck. I have to agree that it looks like the northern brown snake.
