I just read this - horrible! It is almost 5 p.m. here - you are an hour earlier. I hope it is about over, and that the judge sees how ridiculous this is!
 
Update 1a :
Mr. Toney (homeless person living out of his van) Chaney did not show up at today's courtdate. Turns out courtdate notification was sent to his old, 2006 dummy address in New Orleans.
Not correctly(?) to his new dummy address here in Baton Rouge. So court date was reset to Monday, 28 September, pending notification being sent to his "proper current" address.

NOTE : While the judge was deciphering all of this, he had asked me a) why was I here today and b) why I thought Mr. Chaney was not, (that usually the plaintiff was present but the defendant was not...). I was able to unload a pretty good bit of pertinent information...that really did not seem to surprise the judge. Our eyes locked when he said 'well, he may be a no show again, but to make sure this gets settled we must be thorough and comprehensive and mail a notification to the "correct present" address on record'.

So some partial relief. For the moment.
 
ARRRGGHHH! So the saga continues??? Wow, Eric. Respite for a time is still no resolution.

Glad to see that the judge is at least somewhat sympathetic, though. Sorry this thing "continues".
 
I will even extend this to say I resent the socio-political system that does not go on the offensive to stop idiots like these from harassing hard-working, law-abiding, tax-payers like me.

I can't comment on the "stalking" stress because all I could do is suggest filing for your CHL and being prepared in case he ever tries to violently attack you again. As far as I'm concerned, that's the only suitable answer to that particular concern.

I know how you feel, Eric, about he lawsuit, though. Since some time in February, we've been fighting with a property owner who is trying to sue us for over $20k for "gamages" because were were going to buy her house but the bank pulled the loan from us due to EXTENSIVE damages that weren't disclosed by the owner in advance. We found out during inspections. The problem is that our agent made a mistake (2 actually): one we caught and one we did not catch. The one we caught had to do with the amount we were borrowing - she said we were borrowing 10% of the value of the loan instead of 90%. I asked about that since it was written wrong, and she explained it incorrectly telling me SHE had it writen correctly. The second one (the one we didn't catch) was where our agent put the loan date as having to be done prioer to the inspection period. Those two combined made it so we "might" - still might - have actually lost in court. Seller threatened to sue us for not buying since we only needed to finance "10% anyway" and didn't care that this was a typo by our agent, etc. Thankfully, the agent's mistakes make her liable for at least half of the settlement if damages would be awarded to the seller by a court.

Too much money later given to our lawyer, and we have pretty well covered our butt from getting "seriously" sued through follow-up contracts, etc. - but it was a very stresful time when you are looking at being forced out of your old house (it was sold) with 350 breeders snakes (and babies/eggs) and no place to move into except the courtroom.....and a lawsuit that could cost us much of our saved downpayment for a house. Trust me - I understand your stress. In fact, we are in the process of filing suit for our earnest money back mainly just to put the stress back on the seller now. What is great is that the seller's agent released our earnest money to the seller months ago, and we still have not been officially notified by mail. That's a violation of Louisiana law, and she "could" get in trouble with her license for that. Due to the errors our agent made, we are actually able to hold our agent responsible for the lost earnest money. Basically, I'm using the LA laws to get back at them legally instead of the underhanded way they used and ignored them to try and strong arm us into buying a house with damages that they failed to legally disclose in advance.


Sooo, we can get back out or agent who got us into trouble and then dropped us like a hot potato without trying to help us out of the hole and get the sellers agent in trouble for giving away our earnest money illegally. Offensive enough? For me - it is just barely.

Communing with friends definitely helps with the stress.
The first three years of this was really lonely. Well,...my $200/hour lawyer kept me company. LOL.
 
I wish there was more that I could do. I really hate our legal system sometimes the civil part has gotten out of hand!!!!!
 
Another court date?....what a pain in the neck. Though it does sound like the judge sympathizes with you. Lets hope this date will be the last.

Yes, in fact I believe the judgment is said to be in my favor. Means more or less the same, to me.
 
Yes, that is NOT a resolution, although it is better than losing!

I sure hope it is resolved in your favor once and for all the next time you have to deal with this!
 
Oh Eric, I am so sorry this didn't come to it's final conclusion today, as Fred said respite is not resolution! I really hope that next month will finally bring an end to this ordeal for you :)
 
Oh Eric, I'm so sorry this isn't resolved yet. At least you seem to have been able to make headway with the judge.

If I recall correctly from reading through your accounts, if YOU had been the one to not show up the judgement would have automatically gone against you. Interesting, not surprising, but interesting.

Was hoping to come back here and read about a resolution Eric. At this point, one would think it really has to work out in your favor, but stranger things have happened and I'm sure that's what has you on edge. Find a way to (legally) release that stress or worse can happen. :eek:

If you're doing your best to do what's right, it'll work out in the end. It has to!
